Dаn аnd Jаke wоrked tоgether at a car dealership. One night after wоrking hours, Dan decided to take one of the new cars from the lot to pick up Sarah for a late-night date. Jake saw what was happening and confronted Dan about this violation of company rules. Dan reacted angrily to Jake’s assertion of authority and threw the keys at him, barely missing his head. Later that night Dan and Sarah were at a local pub and coincidently, Jake came walking into the establishment. Dan immediately grabbed Jake by the collar of his jacket and dragged him outside and pushed him up against a car so that Jake could not escape. Jake responded to Dan’s physical abuse of him with a verbal taunt. Jake asked, “why are you here. This is where Sarah and I meet every Friday night before we go to my apartment.” This further infuriated Dan, who then responded by furiously punching Jake and pushing Jake’s head into the side window of the car. Tragically, this broke Jake’s neck, and he later died in the ambulance while being transported to the hospital. Discuss all legal issues relating to (a) the encounter between Dan and Jake in the car lot; (b) Dan’s actions leading up to and involving his pushing Jake up against the car; (c) Dan’s violent reaction to Jake’s comment about Sarah. Assume that the common law applies in this jurisdiction.
