Lаte оne evening, just pаst sunset, а 13-year-оld bоy named Timmy was outside in the yard of his family farm.  He was mad at his friend who lived next door for tattling on him for smoking behind the barn, and in frustration, he began throwing rocks at his neighbor’s house.  A rock crashed through the kitchen window, and the broken glass went flying into his friend’s mom Beth, cutting her. Timmy heard Beth yell in pain from the cut, and he took off running.  Looking to get away, he jumped onto his family’s tractor, which he had driven many times, turned on the engine, and started driving the tractor down the local roadway with the lights turned off.  On his way down the road, he accidentally crashed the tractor into a car parked on the side of the road, continued driving, and then ran over a mailbox, flattening it.  Both the car and the mailbox are owned by Steve on Steve’s land. After crashing into the car and the mailbox, Timmy saw lights turning on in Steve’s house, and he knew he needed to get away.  He turned into the next driveway on the roadway, a gravel and sand pit owned by Gravel Co.  The boy had been to the property many times with his family to conduct business associated with the family farm, but the business was currently closed and all the lights on the premises were turned off.  Traveling down Gravel Co.’s driveway, well past the parking lot where customers would park to walk into the nearby storefront to conduct business, the tractor suddenly lurched forward and became stuck in an unmarked and unbarricaded drainage ditch.  Timmy was thrown from the tractor and dislocated his shoulder.  Panicked and in pain, Timmy ran and hid in a large sand pile, where he had gone to play many times before with all of the children of the neighborhood.  The pile gave way and Timmy was  trapped.  He was seriously injured. At the time of the accident, Gravel Co. was in compliance with all local, state, and federal laws and regulations concerning its operation, with the exception of multiple violations of employment law concerning its many employees.  One of the disgruntled employees had negligently left the gates to the facility open and unlocked when leaving work earlier that evening. Timmy’s parents have hired you to advocate for their son.  You need to advise Timmy’s family on who can sue him, and for what.  (35%) You also need to advise Timmy on what lawsuits he can file, and whether he will be successful in recovering for his injuries.
