Pаige wаs neаring retirement, having wоrked in the hоme health care business fоr about 25 years. Over the years she became increasingly tired from the exhausting physical work and started becoming impatient with her clients. In her current assignment caring for Darlene (an elderly lady in her late 80s who was recovering from hip surgery) Paige had to do a lot of physical lifting. She sometimes had to spend 10-hour days with Darlene until Paige’s daughter came home from work to stay with her mother overnight. Paige made sure the agreement she drafted to work for Darlene included a provision that she would get paid $2,000 every other Friday via direct deposit. Furthermore, Paige included a paragraph in the agreement that stated if Darlene failed to make this payment, Paige would be immediately entitled to suspend her duties in providing any services as a home health care provider to Darlene. She also put a provision in the agreement that stated that mandatory arbitration would be required if there was any conflict, but only the home health care worker could recover attorney fees at the arbitration. Paige had been at her assignment with Darlene for about a month when she realized she had not received her $2,000 payment as expected that Friday. After deciding to give her one more chance, Paige quickly drew up another agreement that required Darlene to promise her in writing within a week that she would pay her the $2,000 owed so that she could continue her home health care responsibilities unhindered. If Darlene did not provide her with the requested writing, Paige explained to her that she would be in default of their agreement. Although Darlene needed assistance due to her physical condition, her mind was very alert, and she had become suspicious of Paige. “I have to run that by my daughter,” she replied when Paige thrust the document in front of her to sign. Even after a week, she never gave Paige the requested signed document. Paige felt controlled by Darlene’s stubbornness, so she decided to change her approach. During the morning, she was extremely nice and attentive towards Darlene. Then right before lunch, she started refusing to give Darlene any lunch unless she agreed to give her a piece of jewelry. Paige waited a long time to respond to Darlene’s request for assistance, and when she did respond, she told Darlene she owed her $50 for each time she helped her go to the bathroom. Since she was tired and hungry, Darlene would agree to Paige’s demands. Paige also started threatening Darlene that if she told her daughter what was going on, she would contact the authorities and tell them that Darlene was stealing from her, and she would face criminal prosecution. As a result, Darlene became much more compliant in Paige’s presence. Finally, Paige had enough because she had not received payment from Darlene for her services and told her she was filing a lawsuit. Paige sues Darlene.
