Micrо is а geоgrаphicаlly small rustbelt State. Micrо’s economy historically rested on mining, lumber, and steel foundering. In an effort to boost its fiscally challenged and sagging economy, Micro legalized casino gambling several years ago. Its economy has strengthened. Micro borders a large lake. Through a series of private-public partnerships, Micro erected a large multi-use entertainment facility which it licensed/leased to a private entity, doing business as Bad Boy, Inc. Bad Boy operates a large, floating, non-mobile luxury “barge,” known as The Big Bad Boy. The Big Bad Boy is 100% located within Micro’s border and provides 85% of Micro’s gambling revenues; The Big Bad Boy complex contains a large arena as well as its world-class casino. The arena hosts concerts, professional “wrestling,” rugby and soccer matches, football games, and various other sporting events – professional, amateur, and collegiate, including combat sports events. Micro’s various arena events frequently sell out and contribute millions of dollars to its economy. Tickets for The Big Bad Boy’s sporting events, however, may only be purchased in cash at the gate, no exceptions. Moreover, in distinction from the other sporting events conducted at The Big Bad Boy, the combat sport competitors consist exclusively of Micro residents, and any remuneration or prize money awarded, if any, is also paid in cash on the premises of The Big Bad Boy on the day of the event. No exceptions. Or, at their option, combat sport competitors can opt to receive a comprehensive 15-year exemption from paying any tax imposed by Mirco: income, property, excise, gas, use, et al. The Big Bad Boy’s large casino operation generates revenue and thereby also substantially boosts Micro’s economy. The casino business is conducted similarly to other national and tribal gambling operations. The lake connects Micro and the huge population center of New Knuckle City located across the lake in the State of Macro. Macro prohibits legalized gambling in all forms. Micro operates a free of charge ferry that shuttles people to and from The Big Bad Boy complex and New Knuckle City. Those so transported can patronize either the athletic arena, and/or the casino, or simply view the complex’s spectacular fountains and nightly light and fireworks shows free of charge. Congress has passed and presented to the President a bill that would condition federal public health funding upon whether the recipient states and their Athletic Commissions sanction any form of combat sports. Research, heavily relied on by Congress, has overwhelmingly shown that participants in combat sports suffer from higher incidents of CTE (“chronic traumatic encephalopathy,” aka brain damage), as do football players, bull riders, and circus dare devils. For states that do sanction combat sports, federal public health funds would be reduced 2 dollars for every dollar of gross revenue generated by any combat sport event up to $500,000 and then reduced an additional $10 for every dollar of gross revenue generated over $500.000 up to $999,000. For revenue generated in excess of $1.0M, public health funding would cease. The bill exempts football and other contact sports. The Big Bad Boy generates over $382.0M in gross revenue from combat sports alone each year. If this bill becomes law, Micro’s receipt of federal funds for public health would plumet to zero, leaving a huge funding gap for public health needs. Mirco currently receive $112.0M annually in federal public health funding. Call of the question: The President, who despises combat sports - likening it to “human cock-fighting” - intends to sign the bill, and has asked you, as White House Counsel, to analyze the constitutionality of the bill, presenting both strengths and vulnerabilities should the law be challenged. Your analysis should manifest clarity, relevance, and precision and its analytic scope should focus on the pertinent legal doctrines thus far exposited this semester.
