The agent explained that she was new to the area and unfamiliar with the City’s ADU permitting processes. She added that she had closed many purchases that included ADUs on the properties. Pam purchased a property with a large lot she thought would be suitable for building an ADU. After moving into the house she engaged an architect to design the structure and a general contractor whose bid was the best in her estimation. After paying the architect for the plans and placing a deposit with the contractor, Pam submitted an online application for building permit. After 30 days it was rejected and she was given notice of the opportunity to appeal the denial to the full City Council. At the appeal hearing before the Council Pam was told that two years earlier the City had amended its ordinances and zoning regulations to prohibit the construction of ADUs. The City’s justification for so acting was based on evidence that many of the ADUs that had been permitted were being used as multi-family rental units or as AirBNB short term rentals available to tourists. There were also home owners taking advantage of State funds subsidizing the housing of homeless persons. The City concluded that ADU construction needed to be halted to avoid overstressing Homewood’s infrastructure including health and safety facilities and the City’s educational system. The City Council affirmed the denial of the building permit.
