Art аnd his sоn Ben were hunting оn prоperty owned by Cаrl without the lаtter’s permission. Carl cherished the deer and other animals on his land and considered them to his pets. The sound of gunfire awakened Carl who rushed to the scene of the sound emanating from Art’s rifle. Carl himself then fired two shots from his own gun in the direction of Art in order to scare the intruder from his property and to protect his beloved deer. Unknown to Carl, Ben was standing near his father behind a tree when Carl’s shot struck Ben in the head, killing him instantly. Concerned that he was under attack, Art returned fire against Carl. One of the shots from Art’s rifle struck Carl in the shoulder and disabled him. All of the commotion associated with the ongoing gunfire led Doug, a farmhand who worked for Carl, to rush to the scene with his own rifle. As Carl came into his view, he saw Art running towards his now disarmed and bleeding boss. Doug then took aim at Art and fired two shots directly at his legs. One of the shots struck Art and he fell to the ground. Doug then approached Art, kicked his rifle out of reach and called the local Sheriff for assistance. Discuss all legal issues concerning (1) Carl’s criminal responsibility for the death of Ben; (2) Any defenses Carl might raise concerning his use of force; (3) Any defenses Art might raise concerning his use of force against Carl; & (4) any defenses Doug might raise for his use of force against Art. With regard to calls (3) and (4) discuss both majority and minority approaches to the issue where applicable. Assume the common law applies in this jurisdiction.
