Pаtty is the principаl оf the City Schооl аnd Bob is the representative of the teachers’ union.  They were having lunch at a local café and discussing employees.  An unknown person secretly recorded the conversation between Patty and Bob, which took place in the corner booth of a coffee shop, during their lunch break.  During the conversation, Patty whispered to Bob, “Ms. Smith is a loose woman, who previously gave up her son for adoption.”  Patty was told this information in private by Ms. Smith who asked her not to repeat it as it was very painful for her. The anonymous person sent the recording to a local City Radio Station.  The radio station played the recording immediately after the receipt of the tape. Ms. Smith was appalled at the broadcast and went to Patty’s home to confront her.  Patty was not home. Patty had the school mascot on her front porch.  The mascot was a 6-month-old 105 lb. tiger.  Ms. Smith thought the tiger was cute and began to pet the tiger.  As she was bending over, she lost her balance and fell, breaking her wrist. Unable to confront Patty and wanting revenge for the radio broadcast, Ms. Smith told the Police that Patty assaulted her and broke her wrist.  Patty was charged and arrested, but the case was dismissed in her favor after testimony.   After being absolved from the assault charges, Patty terminated Ms. Smith for lying to the police which was a violation of her contract of employment. Patty sues the radio station and Ms. Smith.  Ms. Smith brings suit against Patty. Discuss theories under which Patty may sue: Radio station Ms. Smith Discuss theories which Ms. Smith may bring against Patty. Do not discus vicarious liability.
