While Ben expressed some initial reservations, Carl pointed out that split three ways, this would be more than enough money to pay off their student debt. So. the three of them agreed to the plan. Ben purchased explosives and Carl obtained a firearm in case things got out of hand. On the day of the caper, the three young men arrived at the data center and were met by a receptionist. Carl, removed the gun from his jacket pocket, pointed it at the receptionist and told her to send the agreed upon message to the corporate “big wigs”. Frightened and weeping, she complied and conveyed the threat to the corporate office. However, to their great surprise, the corporate office sent a return e-mail which read, “Go ahead. That’s why we have insurance.” As a matter of principle, the three men agreed to carry out their threat. So, Art lit the fuse on several of the explosives and was once again surprised to find that Ben had mistakenly purchased fireworks. Although the fireworks obviously did not destroy the data center they did set fire to the facility, which was saved only by the diligence of the local fire department. The three men were apprehended as they sought to escape the scene. Discuss all legal issues regarding: (1) Art’s proposal; (2) the agreement to the plan; (3) the criminal responsibility of the three friends for the events which took place at the data center. Assume that the common law applies in this jurisdiction. However, with respect to the data center fire apply modern statutory law.
