Seаbоаrd Finаnce Cо. (Plaintiff) sued tо recover on a check drawn by Miles Construction, Inc. (Defendant). Plaintiff could not collect the unpaid loan amount from Davies and then sued Defendant. Defendant raised the affirmative defense that the check was given to Plaintiff without consideration and no enforceable agreement existed between Plaintiff and Defendant. The trial court ruled for Defendant, and Plaintiff appealed.
