His recovery is pretty good, however, he will spend the remainder of his life in a wheelchair. He was an enthusiastic hiker but won’t be able to do that any longer. His medical treatment cost $950,000. He was working at a fast-food restaurant earning about $30,000 per year. He could not work for one year but ultimately never went back to work there. He will need future medical treatment because of his condition, but it is unlikely it will get worse. Future medical treatment will cost $250,000. He sues Dylan’s Demolition Derby. At trial, the jury finds in favor of Paxton and awards him special damages of $2,000,000 which consist of medical costs, future medical costs, loss of income and future loss of income.
