Privacy by Intent commissions a study that reveals that TalkTalk collects personal data from its customers when these customers use apps on their phones. Because of the hidden nature of this practice, TalkTalk did not provide to its customers notice at the time of collecting this data and did not discuss this practice in its privacy policy. Hackers accessed Cloud Content’s cloud storage, exfiltrated the personal information of the patients at Memorial Hospital, and then encrypted the information left on Cloud Content’s servers. Hackers then requested a ransom from Cloud Content related to the data from Memorial Hospital. Cloud Content paid the ransom, but the patients’ personal information was not returned. These patients sued Memorial Hospital. Are the patients likely to be successful in their lawsuit against the hospital?
