All events tаke plаce in Everytоwn, Cоlumbiа.  Except as mоdified by the Supreme Court’s First Amendment jurisprudence, Columbia generally follows the common law of defamation except the Plaintiff bears the burden of proof on all issues except damages. On the issue of damages, Everytown follows the common law rules. Pam’s daughter, Victoria, is in the 6th grade at the local public middle school.  Victoria brought home a book from the middle school library entitled “The Sexual Sorcerer.”  Pam examined the book and found that it contained sexually explicit material and advocated for witchcraft.   At the next school board meeting, Pam brought the book’s contents to the attention of the board and requested that the book be removed from the school library.  Darlene, a school board member, told Pam that she should not be so narrow-minded.  Paul, another school board member, said that Pam made valid points and moved that the district’s media specialist investigate the matter and report back to the board.  Paul’s motion carried. After the school board meeting, Pam and Paul met across the street at Joe’s Coffee Shop where Pam further outlined her concerns about school library policy.  Paul was very receptive to Pam’s concerns.  The next day, Darlene, still furious over the prior night’s meeting, talked to her friend, Wilma.  Wilma told Darlene that she had seen Pam and Paul at the coffee shop after the meeting and the two seemed pretty friendly.  Wilma further stated that her friend, Gail, had told her about some woman whose marriage broke up because she was having an affair with her boss but wasn’t sure it was Pam. Darlene called Danny, a reporter for the Everytown Daily Dispatch, and told him that the only reason that Paul supported Pam’s position was that the two of them were “romantically involved.”  Darlene also told Danny that that was par for the course for Pam as she had an affair with her boss. Danny called Willard who he knew to be a friend of Paul and asked Willard if Paul was having an affair with Pam.  Willard said he didn’t think so, but Paul had mentioned that Pam was “cute.”  Under Danny’s byline, the Daily Dispatch printed a front-page article on the school board meeting. The article stated that the citizens should take Paul’s support for Pam with a grain of salt because it was reported that the two were having an affair.  The article went on to say that the public should give little credit to Pam’s moral concerns because she had had an affair with her boss. Pam and Paul were not having an affair, nor had Pam had an affair with her boss. Pam and Paul file separate lawsuits against Darlene, Danny, and the Daily Dispatch.
