While оn rоutine pаtrоl, Officer Odell observed the driver of а silver аnd orange Nissan Quest talking on a handheld device.  She attempted to conduct a traffic stop but defendant made a U-turn and drove his vehicle at a high rate of speed.  Officer Odell called dispatch and determined that this vehicle belonged to Defendant Don who had an open warrant for a homicide that occurred at Old Folks retirement home.  Officer Odell also made a U-turn, activated her lights and sirens, and followed the vehicle to attempt Defendant to make a stop. However, Defendant Don did not stop. Instead a high speed chase ensued. Officer Odell called for backup and the area vehicle enforcement police officers set up a strategic motorcade block about a mile down the road.  This roadblock caused the Defendant Don to crash into police cars and finally came to a stop. Defendant Don did not suffer any major injuries so he opened the door in an attempt to flee. Officers pulled him out of the car and placed him under arrest. Simultaneously, other officers conducted a search of the vehicle on the scene. The search revealed eleven handicap placards under the driver’s seat. Defendant Don was placed in lawful custody and transported to the police station for questioning.  While in transport, Defendant Don immediately began to blurt out, “I don’t know why y’all were chasing me. I am not the one who killed that guy.” The car was impounded and an inventory search revealed the same murder weapon (a Smith & Wesson 9mm) under the driver’s seat. Officer Odell called in to determine the owner of the placards and discovered they were stolen from victims at Old Folks retirement home. Upon arriving at the station, Defendant Don met with Det. Second who conducted an interview of Defendant while in lawful custody. Det. Second advised Defendant Don of his Miranda rights and informed Defendant Don that officers had multiple pieces of evidence against him. Det. Second proceeded to share that they received an anonymous tip regarding a silver and orange Nissan Quest breaking into the vehicles of elderly people at Old Folks retirement home. In addition, on the day of the shooting, officers obtained video footage from the retirement home that showed the same silver and orange Nissan Quest fleeing the parking lot scene minutes after the murder. Defendant Don refused to speak. Later, after confirming all of the handicap placards were stolen from vehicles in the parking lot of Old Folks retirement home, Det. Second charged Defendant Don with first degree murder, possession of a firearm, and possession of stolen handicap placards. Defendant Don remained silent for hours so they transported him to the local jail.  After arraignment, Det. Second went to the jail where Defendant was held. Det. Second asked Defendant Don if he had any information on the handicap placards. Defendant Don sarcastically responded, “It’s my car, isn’t it?” Defendant Don then continued to refuse to speak further and asked the guard to take him back to his cell. Prior to trial, Defense counsel moved to suppress based on Fourth, Fifth, and Sixth Amendment violations.
