Questiоn 4 – 9 Pоints Ace Fix-It is in the business оf providing residentiаl home repаir services throughout the stаte of Wisconsin.  Ace has locations throughout the state and it hires repair persons who Ace regularly sends into its customers’ homes to conduct home repairs requested by homeowners.   Ace was hiring employees and interviewed Jacob Delong as a potential repair specialist.   A state statute requires that in order to protect the safety of the general public, all businesses hiring employees that are likely to perform services in residential homes must perform a state criminal background check prior to hiring the employee.  The purpose of this statute is to prevent employers from hiring dangerous criminals for jobs where the employee is likely to have access to customers in their private homes.  Ace did not ask Jacob Delong whether he had a criminal background and did not run a criminal background check.  In fact, Jacob Delong had two convictions for aggravated assault and breaking and entering into people’s homes.  Had Ace performed a state criminal background check it would have discovered the two prior convictions and it would not have hired Jacob Delong.      Ace did hire Jacob Delong as a repair specialist.   Three months into his job at Ace, Jacob Delong  was assigned to make home repairs in the home of Andrew Carpowski.  While inside Andrew Carpowski’s home, Jack Delong attacked Andrew Carpowski and stole his wallet and valuable personal items.  Andrew Carpowski was seriously injured as a result of Jacob Delong’s  attack.   Andrew Carpowski has sued Ace claiming that it was negligent in the manner in which it conducted the interview process and in hiring Jacob Delong.      Required - 9 Points:  Will Andrew Carpowski prevail in his negligence lawsuit against Ace?  In separately lettered or numbered paragraphs, discuss the elements of Andrew Carpowski’s negligence action against Ace.  DO NOT discuss any claims that Andrew Carpowski may have against Jacob Delong directly and DO NOT discuss in response to this question whether Andrew Carpowski may assert the doctrine of negligence per se against Ace.
