Officer Bob then returned to the Zeus Goose and charged Sam with selling alcohol to a minor and possession of a controlled substance with the intent to distribute it. Sam has filed a motion to suppress arguing that Anna’s entry to the store and her sneaking into the storage room constituted an unlawful search by law enforcement. The State concedes that Anna was an agent of law enforcement at the time and was subject to constitutional requirements, but argues that her actions did not constitute a search.
