Petre is the оwner оf а retаil аrt gallery in a cоastal resort community. Devon is a famous artist who paints popular and attractive landscape paintings. Devon regularly sells paintings to Petre for resale in Petre’s gallery. But Devon had one painting he was not willing to sell. This was a four-foot high and six-foot-long painting of Yosemite Valley that was truly spectacular, It was called the Hlf Dome painting. The painting had been appraised for insurance purposes at three million dollars. Museums and gallery owners were continually pleading with Devon to sell them the Half Dome painting. These included Petre. But Devon loved the painting and did not want to sell it. One day Petre went to visit Devon’s studio. When Petre arrived, he saw a dangerous situation. A large man with a pistol and a large knife was yelling at Devon and threatening him. Deven was lying on the floor and had several deep cuts on his left arm. The armed man was yelling at Devon that he was going to kill him Petre rushed into the studio and grappled the armed mad from behind. Petre was cut several times and shot once but was able to subdue and disarm the armed man. Petre covered the man with the man’s gun until the police and three ambulances arrived. Devon came to visit Petre in the hospital where he was recovering from the wounds he received saving Devon. Devon gave Petre a signed “get well” card. The card said “ I am so grateful for your saving me from that assailant, Because of your sacrifice I will relent to your long-standing request and sell you the Half Dome painting.” Tragically, Devon died in a car accident on his way home from the hospital. Petre immediately set up an advertisement for his gallery announcing that it would acquire and show the Half Dome painting by Devon. Petre contracted for catering on the day he planned to show the painting to the public. Then Petre contacted the estate and tendered payment of four million dollars for the Half Dome painting. But the estate refused to sell him the painting for any amount because Devon;s heirs wanted to keep it. Discuss.
