The Migrаtоry Bird Act (MBA) wаs enаcted by Cоngress in 1988 fоr the protection of migratory birds within the United States and its territories. The statute makes it unlawful to pursue, hunt, capture, kill, or sell nearly 1,000 species of birds listed as migratory birds. The statute’s prohibition applies to live or dead birds and also to any bird parts, including feathers or eggs. In early 2025, the Department of Defense issued a Directive that a small uninhabited island in the Pacific Ocean, belonging to the U.S. and known as Goat Island, could be used for bombing and other weapons testing. Goat Island would be the Navy’s only available testing range in the Pacific, conveniently accessible from several Pacific bases. In addition, the air and sea space in the area would provide sufficient room for the many different attack maneuvers to be rehearsed. The Directive recognizes that the Navy has standard mitigation procedures to prevent environmental damage, but also that the Navy cannot guarantee that no wildlife would be killed during training activities. JustEarth, a nonprofit wildlife organization, filed a complaint in district court seeking a preliminary injunction to prevent the Department of Defense and the Navy from initiating all weapons tests and exercises on Goat Island because of the destruction of migratory birds, in violation of the MBA.
