John has a just good enough idea that he and David should rob customers on their daily pick-up route so it looks like criminals got to the money before the truck arrived. John loves this just good enough idea and tells David and suggests that he and David carry it out. David gives the idea just enough thought to conclude that it is just good enough to work. John and David agree to a plan where John drives the truck slowly down the street with David getting out at the corner, putting on a mask, and rushing up to the customer waiting for the armored truck. David and John agree that David will ‘figure it out” if the customer resists. The next week they carry out the plan. On the pick up day when the jewelry store deposits its cash proceeds Sarah walks out with the daily receipt bag and waits for the truck. Unbeknownst to Sarah, David is getting out of the truck with a mask at the street corner. A minute later, Sarah sees the Bob’s Just Good Enough Security truck driving slowly up the street and also sees a man wearing a mask and dressed in the uniform of Bob’s Just Good Enough Security running towards her with a gun. The man waves the gun as he runs up and tells Sarah to drop the bag. Sarah thinks she is about to be shot and is terrified but does not drop the money bag and instead runs towards the slowly approaching armored car. David sees this and charges Sarah and swings. David narrowly misses hitting Sarah when he swings his fist. However, he eventually knocks her down with his shoulder and grabs the bag. Sarah keeps holding on to the bag which David eventually rips out of her hand while repeatedly hitting her hand and pointing the gun at her. David then jumps into the waiting truck and tells John that their crime was “just good enough” that it might work. John and David complete their route and return the truck and resign immediately intending to live on the fortune of $8,000 they now have. Sarah is thankfully not seriously injured other than bruising and a broken arm and calls the police who immediately locate and arrest the “just good enough” criminals due to their crime that was not “good enough.” Please discuss: Discuss whether David and John can be charged with assault, battery, or robbery.
