Eаrl gоt intо а verbаl altercatiоn with his neighbor, Vern, over their shared fence. Earl believed that Vern should pay for the damaged portion of the fence since Vern’s dog has caused the fence to sag onto Earl’s property. While they were arguing about the fence, Vern grew angry and started climbing over the fence, yelling “I’m going to kill you Earl!” Earl – scared for his life – pulled out his concealed pistol and shot Vern. Vern died from his injuries. A passerby heard the gunshot and called 911. Patrol Officer John Smith quickly drove to Earl’s house to investigate. As Officer Smith was approaching the residence, Earl came running out yelling, “help me, help me, Vern tried to kill me!” Officer Smith secured the scene and transported Earl to the substation for an interview. During a confrontational interview, Earl recounted the events to Officer Smith. At trial, the prosecution has Officer Smith testify about his observations while on scene. The prosecution does not ask Officer Smith any questions about Earl’s statements. On cross-examination, Earl’s defense attorney asks Officer Smith to recount Earl’s statements to help prove Earl acted in self-defense. Earl has chosen not to testify at his trial.  What statements made by Earl, if any, are admissible through Officer Smith? Explain why such statements may or may not be admissible.
