Allen Forrester is a full-time maintenance supervisor for a local county in Southern California. He is 53 years old and has been working for the county for eleven years. On October 1, 2024, during his working hours, he was driving a county vehicle to conduct an investigation of a water pipe leak on a county street. While he was completely stopped at a red traffic light at an intersection, he was struck from behind by another vehicle. His head hit the windshield of the vehicle he was driving and he was knocked unconscious. The air bags deployed in his vehicle. Paramedics arrived on scene to attend to any of the accident victims. A county deputy sheriff also arrived at the accident scene, performed an investigation of the accident, and determined the other driver who hit Allen Forrester’s county vehicle from behind as being the cause and responsible party for the accident. Allen Forrester was taken by ambulance to the nearest hospital for evaluation. In the emergency department of the hospital, he advised the emergency room physician he was experiencing pain in his neck, head, and upper extremities as his only symptoms or complaints of any discomfort. He was hospitalized for three days for observation and then discharged home with prescriptions for medication and physical therapy. After returning home, he contacted his supervisor, Stuart Biggers, on October 4, 2024, and told him about the accident, while he was driving a county vehicle and hospitalization. He was provided a claim form by the employer on October 5, 2024 to fill out and return. He was instructed to go to the industrial clinic the county uses for further evaluation and treatment. As a result of the accident, he missed work for several months, requiring extensive medical treatment and also neck surgery. Allen Forrester casually mentioned to one of his supervisors at a county picnic about two years before the accident of October 1, 2024 he had a prior motorcycle accident about five years ago and sustained a whip-lash type of injury to his neck. Allen Forrester hires an attorney to represent him in an action regarding his injuries and files an application with the Workers’ Compensation Appeals Board on October 30, 2024 claiming injury on October 1, 2024 to his neck, head, shoulders, wrists, elbows, fingers, internal – gastrointestinal and cardiovascular.
