Lenny’s Luthiers regularly buys and sells musical instruments. Ames had never purchased or sold a guitar before. Ames spent $6,000 on the guitar. After playing the guitar for one month, Ames realized that the guitar was way too expensive for him to keep. On February 1, Ames sent the following signed letter to Lenny’s Luthiers. “Help! I made a big mistake. The guitar I purchased from you is more guitar than I need. I would like to sell the guitar back to you for $5,000. Let me know if you will buy it back. I will keep this offer open for 15 days and then I am going to list the guitar on Facebook Marketplace.” Ames signed the letter and dropped it off to the owner of Lenny’s Luthiers, who received the letter on February 2. The next day (on February 3), Ames was mentioning to a colleague at work that he was trying sell his new guitar. Ames’ colleague was a guitar player herself and was very interested in the guitar. She offered Ames $6,000 for the guitar. Ames accepted the offer on the spot. The next day (on February 4), before any attempted acceptance of the first offer by Lenny’s, Ames hand delivered another letter to Lenny’s which stated “Sorry, my offer is no longer valid because I sold the guitar.” Lenny’s was upset about this newest letter from Ames because the owner of Lenny’s had already lined up another buyer for the guitar and was going to make a nice profit. Lenny’s immediately sent a letter to Ames, which was received by Ames on February 5, which stated as follows: “I know you attempted to revoke your offer, but we spoke with our lawyer and we do not view that as binding and we hereby accept your February 1 offer.” The parties now disagree over whether they have a contract.
