Question 5 – 8 Points Maxey MVP Sports, Inc. designs and sells sports apparel.   In 2024, Maxey developed a new hoody (sweatshirt) that it called the “Maxey Full Court Press Hoody”.   The new hoody design includes photographs of various NBA stadiums (used with permission).  The new hoody design has become very popular and has been worn by several NBA players in recent months. The Maxey hoody has been selling very well in the marketplace.  In late 2024, Maxey filed a trademark application with the USPTO, which application for registration is presently under review.  In 2025, Maxey’s competitor, Boston Sports Apparel began manufacturing and selling its own hoody that included pictures of NBA stadiums (also used with permission).   Boston refers to its hoody design as the “Boston Home Court Advantage” line.  Boston has been struggling in recent years and believes that it needs to figure out how it can successfully compete with the Maxey clothing line.  Boston gave its designers pictures of the Maxey hoodies and specifically asked them to try to design the Boston hoody “in a similar fashion as the Maxey hoody.”  Boston has begun selling its hoody at a price lower than the Maxey hoody.  Sales of the Maxey hoody have decreased in part due to the sale of the Boston clothing line Maxey is not happy about this and has sued Boston asserting that the clothing line created by Maxey is a protected trademark and that, under the Lanham Act, Boston has infringed its trademark.  Required – 8 Points:  Will Maxey prevail?  Discuss.  In answering this question, make sure you discuss what is required to successfully claim trademark protection and whether those requirements have been met by Maxey.

Question 4 – 8 Points Ames Pelletier, a local English professor, bought an expensive guitar from a fine instrument dealer in town named Lenny’s Luthiers.  Lenny’s Luthiers regularly buys and sells musical instruments.   Ames had never purchased or sold a guitar before.  Ames spent $6,000 on the guitar.  After playing the guitar for one month, Ames realized that the guitar was way too expensive for him to keep.  On February 1, Ames sent the following signed letter to Lenny’s Luthiers.  “Help!  I made a big mistake.  The guitar I purchased from you is more guitar than I need.  I would like to sell the guitar back to you for $5,000.   Let me know if you will buy it back.  I will keep this offer open for 15 days and then I am going to list the guitar on Facebook Marketplace.”   Ames signed the letter and dropped it off to the owner of Lenny’s Luthiers, who received the letter on February 2.  The next day (on February 3), Ames was mentioning to a colleague at work that he was trying sell his new guitar.  Ames’ colleague was a guitar player herself and was very interested in the guitar.   She offered Ames $6,000 for the guitar.   Ames accepted the offer on the spot.   The next day (on February 4), before any attempted acceptance of the first offer by Lenny’s, Ames hand delivered another letter to Lenny’s which stated “Sorry, my offer is no longer valid because I sold the guitar.”  Lenny’s was upset about this newest letter from Ames because the owner of Lenny’s had already lined up another buyer for the guitar and was going to make a nice profit.   Lenny’s immediately sent a letter to Ames, which was received by Ames on February 5, which stated as follows:  “I know you attempted to revoke your offer, but we spoke with our lawyer and we do not view that as binding and we hereby accept your February 1 offer.”  The parties now disagree over whether they have a contract.  Lenny’s contends that it properly accepted Ames’ offer and therefore a contract was formed.  Ames argues that Lenny’s acceptance was too late.   Required –  8 Points.  Who is correct, Ames or Lenny’s?  Discuss.
