Congress validly enacted a law (“Act”) that prohibits the prescription, provision, or use of “Redux,” a controversial drug that a few years ago had been approved by the Food & Drug Administration for weight-loss, but which causes many serious side-effects in some patients. The law imposes fines on patient-users who use Redux. But physicians who recommend or prescribe the drug, or pharmacists who provide Redux, can be convicted of a felony. Doc is a medical doctor who has prescribed Redux for many of her patients and has found success with their significant losses of weight. Doc brings an action in federal court on behalf of herself and her patients challenging the Act. Doc alleges that the Act interferes with her professional judgment and prerogatives in treating patients and that patients are denied the life-extending benefits of Redux when prescribed and used in a medically controlled therapeutic plan. Pharma Reps, Associated (“PRA”) is a membership organization of pharmaceutical sales representatives that assists drug sales personnel in booking low-cost business travel accommodations.
