Spike аnd Mаlcоlm, twо bоys of the sаme age, had grown up attending school together in the same grade in the same small town. Spike was much larger and stronger than Malcolm, and Malcolm had always been shy and timid. Spike had always bullied Malcolm through elementary school, junior high school, and high school. Both Spike and Malcolm are now 18 years old and are seniors in high school. Recently, Spike had filled a water balloon at the high school, waited for Malcolm outside the school before classes began, and as Malcom arrived, Spike called Malcolm’s name to get his attention and then threw the water balloon at Malcolm. Seeing the water balloon coming, Malcolm was able to dodge the water balloon. Not satisfied, later that same day, at the end of gym class as they were changing back into their street clothes, Spike grabbed Malcolm and pushed him out of the boy’s locker room door into a crowded hallway while Malcolm was wearing only his underwear. Spike held the door shut from the inside so that Malcolm could not reenter the locker room. Other young men and women in the hallway laughed and pointed at Malcolm causing Malcolm to shake, cry, and vomit as Spike held the door to the locker room shut from the inside. Malcolm decided he had endured enough from Spike. So when school was released later that day, Malcolm went to the student parking lot. Using a nail, Malcolm severely scratched the paint on Spike’s car, and, using a knife, Malcolm slashed the sidewall of one of Spike's tires ruining the tire. Malcom then went to Spike’s home and set up a rope snare attached to a tree in Spike’s front yard. Malcolm hid the rope under leaves in Spike’s front yard. As Malcolm had anticipated, Spike found his car with the scratches on the paint and the slashed tire. Irate, Spike changed the tire and drove home. Upon arriving home and parking at the curb in front of his home, Spike strode quickly and inattentively across his front yard, stepping into the rope snare. Spike was immediately snatched up into the air and hung helplessly in the air dangling by one leg. Spike hung from the snare for over an hour until Spike’s father returned home and cut him down.
