Once married, Milton, Wanda, and Sam lived together as one family. Sam never met his biological father. Two years after Milton and Wanda were married (in 2017), Wanda gave birth to another son, Sebastian. Milton adopted Sam immediately after Sebastian was born. At this time, Milton also named Wanda as beneficiary under his life insurance policy and brokerage account. Milton and Wanda eventually divorced in 2019. After the divorce, Milton often said, to anyone who would listen, that Wanda and Sam were extraterrestrial creatures and they had left him to return back to their home planet. Milton claims he never saw or spoke to them again. Contrary to Milton’s statements, Sam routinely called Milton at least once a week to check on him and would bring him food several times per month. One week before his death, Milton executed a document entitled “Declaration of Trust.” Milton declared that he was holding his house, bank accounts, and all of his tangible personal property, in trust for himself for his life and then all of the trust estate should go to his grandchildren, George and Henry, with Oscar serving as Trustee. The Declaration of Trust specifically stated that Milton was not providing for Sam “because money means nothing on Sam’s home planet and because he never visits me”. The Declaration of Trust also contained a clause stating, “In the past, I have given $100,000 to George to help him pay for college, I now intend said sum be treated as an advance against George’s inheritance.” When Milton died, his house and the checking account were titled in Milton’s name as trustee. Milton’s life insurance policy and brokerage account still named Wanda as the sole beneficiary with no one named as a successor beneficiary. Sebastian predeceased Milton, leaving two children George and Henry. Milton was survived by Wanda, Sam, Oscar, George and Henry. 1.
