Pаt hаd been а secretary fоr the sоlо practitioner lawyer Douglas for 20 years in January of 2024. Pat was 68 years old in January 2024. Douglas was afraid Pat would decline in skill as she became older, and began to think about finding a way to get her to retire so Douglas could hire a younger secretary. If February of 2024, Douglas, who type one diabetes took him morning shot but did not eat anything. When Pat arrived at the office at 9 AM Douglas was supposed to be at court. Douglas did not appear at the office by 10 AM, when he was expected back. Pat sent Doulas several text messages about different situations that needed Douglas to make a decision but had no message back. Pat became concerned and called, but got no response. Pat decided to take an unusual step and go by Douglas’ home. Around 11:00 AM Pat went to Douglas house. Douglas’ car was in the driveway and was cold. It was not driven that morning. Pat looked in the windows and saw Douglas passed out on the floor. Pat called 911 and the paramedics came, broke in, and saved Douglas from dying from insulin shock. A few days later Douglas told Pat that Douglas would like to give Pat a pension of $2,000 a month if Pat retired next year in April. Pat had not been thinking about retirement, but the offer was too good to turn down. Pat said “I will retire if you pay me the pension.” Doulas said “You deserve it.” Douglas typed up a note for his accountant about the deal. Doulas wrote “I have promised a pension of $1,800 a month for five years to Pat.” Pat did retire in April of 2025. Douglas died three days later. The executor of Douglas’ estate refused to pay anything to Pat. Discuss.
