Following his arrest, Art sought to negotiate a fine only plea agreement with the police. During the negotiation, Art admitted that he agreed to buy the cocaine. The negotiations soon fell apart, and Art withdrew from any further communications with the officers. Art then hired a lawyer, and the case went to trial. (a) The prosecutor called as a witness the police officer who had attempted to negotiate the plea deal with Art. He testified that Art stated he agreed to buy the cocaine. (b) In his opening argument, Art’s attorney asserted that they would prove that this was a clear case of entrapment. Accordingly, he later called Carl to the witness stand who testified that Art had counseled his son about the dangers of illegal drug use. (c) The defense attorney called Art’s friend, Elise, to the witness stand who testified that, in her opinion, Art had been emotionally devastated by the loss of his own mother to cancer and would do anything to help someone in the same situation. (d) A former partner of the officer who arrested Art was called as a witness by the defense counsel. He testified that they wrote a note to Ben informing him that unless he could facilitate more arrests, he was going to do time for his own illegal drug activities. Despite repeated attempts to obtain the note and the service of subpoenas on both the arresting officer and Ben, the note could not be obtained. The witness testified under oath that he did not have a copy of the note. Discuss all legal issues relating to how a court would rule on the admissibility of the evidence discussed above.
