On July 3, 2026 аbоut 11pm, Mаry, а stоre clerk, was rоbbed. She immediately called 911 and said, “A man came into the store with a revolver handgun with silver tape around the handle, pointed it at me, and demanded money, which I handed over and he ran out.” Less than 5 minutes later, Officer Jones stopped Daniel about two blocks from the store. Daniel gave consent to search his backpack where a revolver handgun with silver tape around the handle was seized and Daniel was arrested. No money was found. Officer Jones took the gun and immediately placed it in an evidence bag. He dated and signed the evidence bag and sealed it. He then placed it in the police evidence locker. Officer Jones then checked out the gun from the police evidence locker and brought it directly to court. Officer Jones also obtained a store surveillance photograph date and time stamped July 3, 2026, 11:05 pm. The photograph showed a person looking like Daniel with a revolver handgun with a silver taped handle pointing it at Mary. At a pretrial hearing, Jones testified about how he recovered and subsequently handled the handgun. Mary testified the photograph is from her store and she is familiar with how the surveillance store system takes the photograph and preserves it. Mary said the photo fairly and accurately showed her and the man holding the gun at the date and time of the robbery.
