Furious regarding his failure to get a good deal on the shells, the client got into his car, put the gear shift in reverse, hit the accelerator to the floor, and without looking, struck an elderly man, killing him instantly. Telling himself “the old guy will be alright,” the client then drove home and was met at the front door by his mother. An argument then ensued over the fact that he had not paid her rent for three months. In order to shut her up the client hit her over the head with a heavy ash tray, knocking her unconscious. In light of his stressful day, the client decided he needed to relax and drove to Johnny’s Place, a local bar. To his surprise, the client’s brother was at the counter and greeted him with the admonition that “you better pay mom for your back rent.” The client had heard enough and punched his brother in the face, breaking his nose. In the meantime, the client's mother died of intracranial bleeding. On the basis of your interview with the client, the senior partner has asked you to prepare a memorandum for him. You are to analyze all legal issues relating to (a) the threat made to the cashier; (b) striking the elderly man with his car; (c) the death of the client’s mother; and (d) the incident at the bar involving the client’s brother.
