A pоlice helicоpter is mоnitoring the trаffic flow one wаrm dаy at approximately 500 feet (within FAA limits). The pilot happens to glance down when he sees a beautiful pool in someone’s fenced backyard. However, he is shocked to see what looks like young boys (10-13 yrs.) engaged in sexual activity around the pool. Further, there appear to be several adults filming the activities. He immediately notifies the area patrol. The ground unit finds the address, kicks open the gate to the backyard and enter the pool area. The pilot’s suspicions are confirmed that they are filming kiddie porn. The adults are arrested. Is this a constitutional search?
