Before he started leaving them in the box, Phillips had been able to sell them over the internet for an average of 50 cents each. Each day, Davidson looked through the box. Davidson notes the shells she wanted to buy, puts them on display in the store, and throws the others away. At the end of the month, Davidson sent Phillips a check for $1 for each shell purchased. This amounted to $100 for 100 shells. Phillips was upset when the check arrived. Since no shells were returned to Phillips in any way, Phillips had expected $300. Phillips goes to see Davidson who explains that she thought it was understood she would only pay for the shells she wanted to buy. Davidson said she only wanted fancy shells like the Black Murex she bought when they met. Other shells, like the Atlantic Welks, were too plain. Phillips says the shells he left were all like the shells he sold Davidson before and none were simple clams or mussels. Phillips expected to be paid for all of them, and Davidson should have left the unwanted shells in the box with an explanatory note so Phillips could sell them to someone else if she was not going to keep their agreement to buy all the shells. Davidson insists she never said she would buy all the shells and Phillips never asked for the return of unwanted shells. Discuss.
