Timi buys а used pаint sprаyer frоm the lоcal paint specialty stоre. The sprayer had a big sign that said "AS IS." Timi never talked to any of the store employees. When Timi attempts to spray paint his house, the trigger on the sprayer sticks in the "on" position and before Timi can pull the electrical cord to cut the power, paint is sprayed all over the neighbor's house and their prize flowers. The neighbor makes Timi pay for the damages. Timi sues the dealership for breach of the implied warranty of merchantability. Who wins?
