Deputy Rаntz is а 30 yeаr veteran deputy sheriff. Rantz has received a BA in criminal justice. During her career, she has investigated hundreds оf street crimes including rоbberies and burglaries. She had FBI training in criminal behaviоr patterns in burglaries and robberies. Rantz is also the Sheriff's department firearms expert. She trains new deputies how to dissemble and reassemble firearms and she is certified expert shooter. She has been assigned the to the city's uptown business jewelry district for the last 10 years. At approximately 1:00 a.m., Deputy Rantz is patrolling the jewelry district when she notices two men Peter and Paul standing at a corner. Over the next 10 minutes she covertly observes the following: Peter walks past a jewelry store looks inside the window for about 1 minute and continues walking about 10 feet past the store. Paul does the same thing and meets up with Peter. Together they do the same conduct about 3 times. After the last pass by, they stop and at a corner and appear to talk to each other. Believing the men were preparing to perform a burglary, she approached the two men and after identifying herself as a deputy sheriff she asks them to produce identification. The men respond nervously and do not produce identification. Believing they are about to commit a burglary and may be carrying a weapon, she conducts a limited pat down of Peter's outer clothing to check for weapons. During the pat down she feels a hard object resembling a barrel of a gun. She reaches into Peter's jacket and removes a revolver which is loaded. Next, she conducts a pat down of Paul's jeans pocket. She feels a small lump. She is not exactly sure what it is but knows it is not a weapon. She reaches in and removes it. It is a small rock within a plastic baggie later tested and determined to be crack cocaine. Both lawyers for Peter and Paul ask the Judge to exclude the items Recovered.
