He stated that he had been walking a beat when he heard someone yell “please help, someone please help me.” The officer determined where the calls were coming from (the home) and he entered. When they ask her what happened, she stated that her son stabbed her because she would not give him money for drugs. She then lapses into a coma. The son is arrested for felonious assault. Defendаnt went intо trаffic cоurt аnd pleaded guilty tо running a stop sign and causing a minor accident. He told the Judge, “Your Honor, it was an accident. My foot slipped off the brake pedal.” Eight months later he is sued by the other driver for 1 million dollars. The defendant knows that the other driver is nothing but a blood-sucking loser who is faking injury to get money. He decides to fight the suit and denies that he was completely at fault, stating that the other driver had been speeding which caused the accident. The driver of the 2nd car subpoenas in the Judge from Traffic Court and wants him to repeat defendant’s statements made in that court. Are the statements admissible? Why or why not?
