In response to Officer Kennedy’s questions, Art repeated some of the inculpatory statements he had made in the earlier discussion with Officer Johnson. On the basis of his statements to Officer Kennedy, Art was arrested and placed in a cell with another prisoner who happened to be a jailhouse informant named Ben. After a few pleasantries, Ben began to probe Art concerning the reasons for his incarceration. Art, with a desire to impress his cellmate, began to describe the details of his involvement with the burglaries. Using the statements obtained by Ben, the district attorney brought formal charges against Art by filing an information relating to the burglaries. That evening an attorney hired by Art’s wife called the police station and informed them that they were not to question her client. The desk sergeant assured the attorney that there were no plans to question Art that night. The following morning Art was taken to the interrogation room where he was given Miranda warnings and questioned by Officer Johnson about an aggravated assault which had been brought to his attention by one of the burglary victims. Art said he understood and agreed to talk about it but indicated that he would not agree to sign anything. Officer Johnson assured him that this was just an informal conversation between friends and Art proceeded to incriminate himself with several inculpatory statements. The following day the assault victim selected Art’s picture from a selection of photographs provided by Officer Johnson. The victim selected a picture of Art as the perpetrator. Art is a male Caucasian. Except for the picture of Art, all of the other pictures shown to the victim were Hispanic and African-American suspects.
