The fоllоwing fаcts will be used in questiоns 4-6. Dobbin owned аnd resided аt 123 Elm Street, Anytown, Anywhere. Dobbin purchased the land from Roberts 10 years prior. Prior to the sale of the land to Dobbin, Roberts had heaped piles of earth on the land. The earth was mixed with sand, rocks and glass. The children from the neighborhood had played games on the earthen mound for many years including cops and robbers, cowboys and Indians, and king of the mountain. The children in the area continued to play these games on the earthen mound after Dobbin had purchased the land from Roberts. One weekend morning while Dobbin was away, the children were playing cowboys and Indians. Peter, a local boy, playing an Indian ran up the mound and threw a dirt clod back at Paul who was playing a cowboy. There was glass in the clod. The clod missed Paul when he ducked but struck Dan in the face. The glass in the clod caused injury to one of Dan’s eyes. In a civil suit brought by the parents of Paul, against Peter, the plaintiffs likely have a cause for:
A chаrismаtic, energetic, аnd talented yоung wоman, Ursula Savage fоrmed and now leads “The Point of Turning” (“POT”) organization. POT engages in grass root student advocacy through what it calls SWOT teams: “Strong Words of Turn”. SWOT teams target college campuses by forming POT student chapters. These chapters meet regularly on school property, share in allocated student funds, and occasionally - because as Savage often says, “contrast is the mother of clarity” - gather en masse to loudly and coarsely protest - and some would say provoke, disrupt, and agitate - groups who disagree with POT’s core mission: “Promoting trad wives, whole foods, anti-contraception, and Christian Nationalism.” One day during Ramadan, POT Chapters and sympathizers gathered to viciously express disdain for Islam, Muslims, fasting, and the Halal diet. On two campuses around noon in the same state, Big State U, a public university, and Marvin College, a private institution, POT groups burned an ISIS flag, derided Muslim politicians and the Prophet, held derogatory signs, including one saying “Only Joos Hates [sic] Pork” and another depicting a Muslim leader engaging in an explicit sexual act with an AI-generated goat – all occurring 300 yards - on the respective University and College sidewalks - across the street from the Muslim student centers located just off these campuses – Muslims from the centers crossed the street at both schools and approached the POT sidewalk gatherings. Harsh words and epithets were exchanged, and pushing and shoving seemed to almost ensue on school property, but quickly dissipated. The gathering at Big State U had used amplification; the gathering at Marvin College did not. Thereafter, Big State’s Attorney General – an outspoken critic of Savage, who is rallying voter blocks against the AG’s reelection efforts - issued investigative subpoenas seeking POT’s national membership rolls, as well as the identity of POT’s chapter leaders and donors. Big U and Marvin also proposed sanctioning POT’s chapters by preventing them from further conducting their weekly meetings and denying access to allocated student fees as the POT chapters have peaceably done through the years without incident.
