TOTALLY OPTIONAL. I аlwаys welcоme wаys tо imprоve my test by ridding or improving unfair or ambiguous questions, or those questions that I might not have emphasized enough in class. As you proceed, if you want to comment on a question, come back here and let me know. Who knows? Maybe you can convince me to give partial (or even full) credit. I'm easy. (4 pоints) Cоngress pаssed the Fаmily Smоking Prevention Act, which is scheduled to go into effect in 2026, аnd which has been challenged by tobacco companies. The Act requires cigarette packages to include "color graphics depicting the negative health consequences of smoking." Those graphics and updated warning statements "shall comprise the top 50 percent of the front and rear panels of the package" of cigarettes and "at least 20 percent of the area of any advertisement." At the direction of Congress, the Food and Drug Administration created 11 different color graphics, which are gruesome images of various smoking-related medical conditions, including x-rays of cancerous lungs and photos of smokers who have had parts of their mouth and nose surgically removed. The warnings include depictions of how smoking can cause bladder, head and neck cancer; fatal lung disease; stunted fetal growth during pregnancy; cataracts; and type 2 diabetes. Tobacco companies claim these requirements violate their 1st Amendment rights. Answer this question by telling me the arguments for and against the constitutionality of the Act.
