Twо friends, Pete аnd Dаve, hаve helped each оther with variоus projects. Pete was a carpenter and Dave a plumber. Pete needed plumbing work done in his house, so he called Dave. Dave went over to Pete’s house to assess the work, and told Pete that the fix would be a $10,000 worth of work, but that he was going to do it for Pete free of charge, or rather for $1, as long as his clients paid their past-due invoices on time that month. Dave said that he was grateful that Pete had done some carpentry work for him at no cost the previous year. Pete paid Dave $1 with his credit card. Dave proceeded to fix Pete’s plumbing. The following week, Pete noticed a $10,000 charge on his credit card from Dave, following the $1 earlier charge. When Pete called Dave to ask about the $10,000 charge, Dave said that he had too many clients who hadn’t paid what they owed. Dave refunded Pete his $1. Assume that Pete was not able to contest the $10,000 charge with the credit card company. Pete sued Dave. Discuss under Consideration and Promissory Estoppel only.
