While Alex wаs seаrching оn the Internet fоr а bike, a videо popped up on Alex's computer screen. This video was an advertisement for a bike made by a bicycle manufacturer called Boomerz. This ad showed a cyclist riding a Boomerz "X Model" bike over very rough mountain terrain. After seeing this ad, Alex placed an order for an X Model bike with ShopSmart. ShopSmart is a retailer that sells products at its brick-and-mortar stores and also online. The next day, a large box was delivered and placed on Alex's front porch. This box contained the the unassembled X Model bike. Alex opened the box and laid out all of the pieces that needed to be put together. Alex then spent the next several hours assembling the bike. Once he finished, Alex threw the box away. Alex was unaware that a small card had been loosely placed inside the box he had discarded. The card stated: "WARNING! THIS BIKE IS NOT SUITABLE FOR OFF-ROAD USE!" Later that afternoon, Alex and his friend Paul went for a bike ride on a mountain trail. At some point, Alex and Paul switched bikes so that Paul could try the new X Model bike purchased by Alex. As Paul was riding, the front fork suddenly bent and collapsed. Paul crashed and was badly injured. Later investigation revealed that the front fork of the bike had collapsed because it was made from an inferior metal alloy. This type of metal alloy could not withstand the forces generated when riding over rough terrain. All X Model bikes were made from this inferior metal alloy.
