The company employs more than 20 workers. The complainant alleges, and your investigation later confirms, that the labor agency classified applicants by race, sex, national origin, and age. The agency used code words to classify the applicants such as “hockey player” for young White males, “basketball player” for Black males, and “chocolate cupcake” for young Black women. The temporary agency then assigned the applicants to jobs based on those classifications, as well as the preferences expressed by the hiring company for a specific gender, race, age, etc. Is this a lawful employment practice? If your answer is no, what federal statutes (plural) have been violated and how? Your essay must identify the statute, and the types of claims that the EEOC may find this company to be in violation of (disparate treatment, disparate impact, retaliation, etc.).
