He plans to rent out the remaining floors. James is in negotiations with Sam, who owns the two acres. James tells Sam that he plans to build a ten-story building on the two-acres, and Sam tells James that town zoning regulations/laws allow ten-story buildings to be built on the land he is buying. In fact, the town zoning regulations/laws prohibit buildings higher than two stories. (Neither James nor Sam know this fact.)
