Burley had never purchased or sold a mountain bike before. Burley spent $5,000 on the bike. After riding the bike for one month he decided that mountain biking was not for him. On September 1, Burley wrote the following letter to Madison Bike Sales: “I know I purchased this bike and used it, but mountain biking is just not for me. I would like to sell the bike back to you at a very good price. I will sell you the bike for $3,000. I will keep this offer open until September 20 and then will list the bike on Craigslist.” Burley signed the letter and dropped it off to the owner of Madison Bike Sales, who received the letter on September 1. On September 5, four days after delivering his offer to Madison Bike Sales, Burley’s neighbor heard that Burley was selling his bike and told him he would pay Burley $4,000 for the bike. Burley immediately accepted the neighbor’s offer on September 5, and delivered another signed letter to Madison’s which stated: “Sorry, I got a better deal on my bike and therefore you can ignore my September 1 letter.” This communication was received by Madison Bike Sales on September 5 as well. On September 8, Madison’s owner called Burley and informed Burley that Madison’s was accepting the September 1 offer and on the same date hand delivered a signed letter to Burley accepting the September 1 offer, which letter was received by Burley on September 8. Madison Bike Sales stated on the call and in its letter: “I know you revoked your offer, but we do not view that as binding and we hereby accept your September 1 offer.” The parties now disagree over whether they have a contract. Madison Bike Sales contends that it properly accepted Burley’s offer and therefore a contract was formed. Burley argues that Madison’s acceptance was too late. Required – 6 Points.
