The medicаl stаff cоmmittee аt Lоcal Hоspital is tasked under the Hospital bylaws with reviewing physician applicants for clinical privileges. The committee receives an application from Dr. Miller, a recent hire at a nearby surgical group practice.  Local Hospital has granted many physicians from this group practice clinical privileges, including a few physicians on the medical staff committee.  Since the Hospital is in desperate need for another surgeon and since Dr. Miller has already been vetted by the group practice, the medical staff committee recommends to the board of directors that Dr. Miller be granted privileges and doesn’t perform its typical investigation of an applicant for privileges.  The board approves the granting of clinical privileges to Dr. Miller based on this recommendation Two days after Dr. Miller begins performing surgeries at Local Hospital, he operates on the incorrect leg of a patient.  As if this wasn’t bad enough, when the incident is referred to the Hospital peer review committee, the committee discovers that Dr. Miller had multiple reports in the National Practitioner Data Bank, and 2 of his 4 professional references listed in his application didn’t even exist.  It turns out that Dr. Miller wasn’t properly vetted by the surgical group practice after all, unbeknownst to the members of the medical staff committee.  When applying for the position with the group practice, a family friend of Dr. Miller who was one of the leading physicians at the group practice hired him without reviewing the application. If the patient files a lawsuit for damages from having the incorrect leg operated on, Local Hospital might be liable for the patient’s injury through a claim of
